TERMS AND CONDITIONS
Maybe is a social media website and mobile application provided by Maybe Meetings and designed to enable for its users to meet and interact with and share information with other people. Maybe Meetings purpose is to provide a service that in an easy, efficient and fun way provides a safe and friendly environment to enable its users to interact. By accessing or registering for Maybe you agree that you will only use Maybe in accordance with these terms and conditions(the “Terms”) and in a manner that conforms with the intended purpose.
The Terms constitute a legally binding agreement between you as registered user of the Maybe service, (the “User”) and Maybe Meetings AB, a company incorporated under the laws of Sweden with Swedish corporate no 556963-1632, whose registered office is Klarabergsviadukten 90, 111 64 Stockholm, and with registered website and www.maybeapp.com (together with affiliated websites and applications, “Maybe Meetings”). The Terms apply when you install and whenever you access the Maybe mobile application (“Maybe”) or the www.maybeapp.com website (the “Website”) and whether or not you have chosen to register for Maybe. If the User accesses, registers for or receives any of the services offered on Maybe or the Website (the “Services”) you are accepting and agreeing to be bound by the Terms.
IF YOU DO NOT ACCEPT AND AGREE TO THE TERMS THEN YOU MUST NOT ACCESS OR USE MAYBE OR THE WEBSITE.
Maybe services are offered exclusively to adults. A User may only use and become a registered member of Maybe if the User is over the age of 18.
The User warrants that they have the right, authority and capacity to enter into and be bound by the Terms and will not be violating any law or regulation of the country in which the User resides by using the Services. The User is solely responsible for compliance with all applicable local laws and regulations.
The User further warrants that they have not previously been convicted of, nor are subject to any court order or restriction relating to assault, violence, sexual misconduct or harassment.
A User can use Maybe to post information on, including photographs, emails, messages, instant messaging and other content (“Content”).
A User may not under any circumstance post or send any Content which:
- contains foul or inappropriate language which could be deemed offensive or is likely to harass, upset, embarrass, alarm or annoy any other person;
- is of obscene or, pornographic nature;
- is abusive, insulting or threatening, or which promotes or encourages racism, sexism, hatred, xenophobia or bigotry;
- incorporates the image or likeness of any individual under 18 years of age;
- promotes or encourages any illegal activity including, without limitation, gambling, terrorism, inciting racial hatred or violence or the submission of which in itself constitutes committing a criminal offense;
- is defamatory;
- serves to defraud, deceive or swindle other users;
- disseminates any third party’s personal information without their permission;
- relates to commercial activities (including, without limitation, sales, competitions and advertising, links to other websites or premium line telephone numbers);
- contains any spy ware, adware, viruses, corrupt files, worm programmes or other malicious code designed to interrupt, damage or limit the functionality of or disrupt any software, hardware, telecommunications, networks, servers or other equipment, Trojan horse or any other material designed to damage, interfere with, wrongly intercept or expropriate any data or personal information whether from Maybe or otherwise, or is intended for the purpose of phishing; or
- involves the transmission of “junk” mail or “spam”;
- is, in the sole judgment of Maybe Meetings, objectionable or restricts or inhibits any person from using or enjoying Maybe or exposes Maybe or its users to harm or liability of any type.
- itself, or the posting of which, infringes any third party’s rights (including, without limitation, intellectual property rights and privacy rights).
Maybe requests that the User adopts common sense in choosing the Content that they provide or send via Maybe. The User is solely responsible for, and bears all liability in relation to, such Content.
Content uploaded to Maybe by the User may to some extent be accessed and viewed by the general public, including but not limited to Profile pictures, nickname, gender, age, city of residency, presentation and number of mutual friends on Facebook®.. Maybe Meetings reserves the right (without any obligation of sorts) at their sole discretion and without prior notice to the User, to remove or edit, limit or block access to any Content that the User provides, uploads or spreads on Maybe without any incurring liability towards the User. Maybe Meetings has no obligation to display the Content uploaded by the User on Maybe, nor to review or examine any Content or it´s accuracy or truthfulness of such. For the avoidance of doubt, Maybe Meetings has no obligation to monitor the Users use of or Content on Maybe.. Maybe Meetings may at their own discretion use a third party to monitor the Users use of Content on Maybe. Mobilseapps may create test profiles or accounts to monitor the operation of the Services.
Provided that the User is the rightful owner to the Content published by the User on Maybe, the User retains full ownership to such Content.
By uploading or spreading Content on Maybe, the User represents and warrants the right to do so, and automatically grants Maybe a non-exclusive, royalty free, perpetual, worldwide licence to use such Content in a way that Maybe at their own discretion finds suitable (including, without limitation, copying, editing, modifying, translating, adapting, reformatting, incorporating into other works, creating derivative works from, advertising, distributing and otherwise making available to the general public such Content, whether in whole or in part and in any format currently known or developed in the future) for the purpose of supplying the Maybe service.
Maybe Meetings is entitled to assign and/or sub-license any such license to Maybe Meetings affiliates and successors without any further consent by the User.
By submitting Content to Maybe, the User warrants that such content is an expression of the Users own creativity, The User warrants that they are the rightful owner of the submitted Content. The User and waives any and all moral rights relating to that Content (including, without limitation, the right to be identified as the author).
A User may not grant or authorize other people access to a Users Maybe account. The User understands that any such grant or authorization of access may compromise the security of Content and personal information that the User may have submitted to Maybe or Maybe Meetings. Passwords and any other information used to identify a User are strictly private and confidential and must not be passed on or shared with any third parties. Maybe and Maybe Meetings are not liable for any unauthorized access to the Users account due to the Users failure to abide to the Terms. Maybe Meetings reserves the right to terminate a User account upon violation of these Terms.
In the Users interactions with other users (including, but not limited to: site messages, instant messages, postings, and chat conversations), the User agrees to conduct themselves civilly and respectfully. While using the Service, the User agrees not to under any circumstance harass or make mischief against any other user of the Maybe service. Maybe Meetings reserves the right to determine, at its sole discretion, what constitutes harassment or mischief, and where that has occurred; and may, also at its sole discretion, partially or completely suspend service to any infringing party unable to comply with the Terms in this respect.
User may not display any personal contact not related to the Maybe service or any information intended to facilitate payments or transfer of money or deeds on Profile, whether in relation to the User or any other person (for example, names, home addresses or post codes, email addresses, telephone numbers, URLs, IP-adresses, credit/debit card or other banking details). Any personal information the User chooses to reveal about themselves to other users, whether via email or otherwise, it is at their own responsibility and risk.
The User may only use other Maybe user’s personal information (“Third Party Information”) that relates to Maybe’s purpose of providing a meeting place for people to meet one another, for example by assisting the Users Maybe connections get the most of their Maybe experience. Third Party Information may not be used for commercial purposes, to spam, to harass, or to make unlawful threats. Maybe Meetings reserves the right at their own discretion and judgement to terminate a User account if the User does not comply with restrictions regarding Third Party Information.
The User shall take necessary precautions when interacting with other users, especially when deciding to meet other people in person. Maybe Meetings urges the User to report any user that shares Content in breach of the Terms by using the report function described herein. Maybe Meetings recommends using safe dating practice and that the User refrains from sharing personal information while interacting with other users, including but not limited to surnames, home or email addresses, work place, telephone numbers and financial information (such as debit or credit card information or bank account numbers). Maybe Meetings is not liable for any Content provided to the User by other users of Maybe.
Any and all texts, trademarks, logos, graphics, user interfaces, sounds and artwork on Maybe are owned, controlled or licensed to or by Maybe Meetings and are, to the extent provided by law or otherwise, protected by copyright, trademark and other intellectual property rights.
Without restricting the use of Content submitted by the User to Maybe, the User does not have any rights relating to any Content on Maybe. The User agrees not to use any Content in a manner that may infringe or cause infringement of any third party’s rights. Without limitation to the foregoing, the User agrees not to copy, adapt, modify, distribute, publish or sell any Content on Maybe in whole or in part (other than the Content submitted by the User) to any third party.
Maybe Meetings withholds the right to disclose a Users identity to any third party that may file claim of violation of their intellectual property or right to privacy or any other legal rights, if such claim arises from the Users upload or post of Content to Maybe.
The User may purchase interaction possibilities with other Maybe users by single in-app purchases of Maybe Credits or through a recurring subscription service of unlimited Maybe Credits (“Maybe Unlimited”). Such additional services may vary from time to time and serve to give the User opportunities to interact and meet other Maybe users. For instance, Maybe Credits enable for the User to say hello to other Maybe users and add as them as followers. Maybe Credits can be purchased upon or after User registration, or the User may opt to subscribe to Maybe Unlimited on a recurring monthly basis. Prices and terms for payment are published on the User Profile. Any payment by the User to Maybe Meetings or Maybe for Maybe Credits or Maybe Unlimited is non-refundable.
Upon a User subscription to Maybe Unlimited, the User authorizes Maybe Meetings to charge the User on a monthly basis by the Users choice of payment method. To cancel a subscription to Maybe Unlimited, the User must do so through the third party service provider from which the User installed the Maybe application, including but not limited to iTunes® App Store and Google Play™. The User acknowledges that the third party service provider has separate terms and conditions that may apply to the User. Maybe Meetings takes no responsibility for the Users obligations towards such third party service provider. A User subscription to Maybe Unlimited will automatically renew on a monthly basis until cancelled by the User. Maybe Credits or subscription to Maybe Unlimited may not be transferred to another Maybe user.
Maybe Meetings reserves the right to expire any unused Maybe Credits 6 months after purchase if the User under a 6 month period following the purchase fails to make use of the Maybe Credits. If User deactivates or terminates the User Profile or Maybe account or if the Users Maybe account is terminated by Maybe Meetings due to the Users breach of these Terms, all accumulated Maybe Credits will be forfeited, unless the User restores the Maybe account Maybe Credits are not redeemable for any sum of money or monetary value.

Access to the site
The User understands that Maybe Meetings from time to time may carry out maintenance to the Maybe service, or that the Maybe service may be affected by a fault or circumstances which are outside of Maybe Meetings control. Maybe and the Services are provided on an “as is” basis. Maybe Meetings does not warrant, express or implied, the quality, accuracy, functionality, availability or performance of Maybe. Maybe Meetings reserves the right to suspend, withdraw, amend, modify or vary the Services provided on Maybe without notice and without incurring any liability to the User.
It is the Users own responsibility to make all necessary arrangements to ensure the Users access to Maybe or the Services from their mobile device (including, but not limited to Internet provider and mobile internet provider fees and, any other charges associated with such access). Maybe Meetings holds no responsibility for any reduced functionality the User may encounter as result of or in connection with accessing Maybe through mobile services or any similar service necessary to gain access to the Maybe service.
The Users access to Maybe or the User agreeing to receive messages or notifications from Maybe or Maybe Meetings through a mobile phone or any other connected device may result in any charges being incurred on the User by their internet or mobile service provider. Maybe Meetings or Maybe shall not under any circumstances be liable for such charges.
Non-registered users are able to access only the portion of Maybe that is publicly available and will not have the ability to upload any Content or create a Profile. The extent of non-registered users’ access to Maybe an other Maybe users may be subject to change from time to time without prior notice and at Maybe Meetings discretion.
A User may report any abuse or complaint about Content on Maybe by contacting Maybe Meetings via, detailing the abuse and/or complaint as may be applicable. A report against another Maybe user can be filed directly from that user’s profile, by clicking the ‘Report’ link on their profile, choosing the reason for the complaint (including, but not limited to, stolen images, questionable content, misconduct and spam) and providing Maybe Meetings with any additional information necessary for processing the report.
Maybe Meetings has no control over and makes no representations with respect to the contents of any third party sites, nor accepts any responsibility for third party sites, including (but not limited to) the third party site’s compliance with any applicable laws or regulations.
Disclaimer; limitation of liability
Maybe Meetings expressly disclaims any and all responsibility and liability for any and all User conduct or the conduct of any other user of Maybe, and expressly disclaims any liability for Content uploaded by the User or by any other user of Maybe or the Services, unless such liability cannot be limited or excluded by law.
To the fullest extent permitted by law, Maybe Meetings expressly excludes:
- all conditions, representations, warranties and other terms which might otherwise be implied by statute or law; and
- any liability incurred by the User arising from use of Maybe or the Services , including without limitation for any claims, charges, demands, damages, liabilities, losses or expenses of whatever nature and whether direct, indirect, incidental, special, exemplary, punitive or consequential damages (however arising including negligence), loss of use, loss of data, loss caused by a computer or electronic virus, loss of income or profit, loss of or damage to property, breach of contract or claims of third parties or other losses of any nature, even if Maybe Meetings has been advised of the possibility of such damages or losses, arising out of or in connection with the use of Maybe or the Services. This limitation on liability applies to, but is not limited to, the transmission of any disabling device or virus that may infect the Users equipment, failure of mechanical or electrical equipment or communication lines, telephone or other interconnect problems (e.g., the Users inability to access their internet or mobile service provider), unauthorized access, theft, bodily injury, property damage, operator errors, strikes or other labor problems in connection with Maybe including, without limitation, any liability for loss of revenue or income, loss of profits or contracts, loss of business, loss of goodwill, loss of data, and any other loss or damage of any kind, however arising and whether caused by tort (including, but not limited to, negligence), breach of contract or otherwise, even if foreseeable and regardless of whether such loss arises directly or indirectly.
If any third party brings a claim against Mobilseapps as the result of the Users use of Maybe or the Services, Maybe Meetings retains the right to defend or settle the relevant claim at their sole discretion and in a manner that Maybe Meetings finds appropriate. Upon the request of Maybe Meetings, the User will fully co-operate and take reasonable measures to aid Maybe Meetings in the defence of any relevant claim.
The User agrees to hold harmless and indemnify Maybe Meetings and their officers, directors, employees, agents, representatives and licensors from and against any third party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs and expenses (including reasonable solicitor’s fees) suffered or reasonably incurred by Maybe Meetings arising as a result of, or in connection with, the Users access to and use of Maybe or the Services, the uploading or submission of Content to Maybe by the User or the Users conduct, other than in accordance with the Terms or any applicable law or regulation (“Claim”). Maybe Meetings retains the exclusive right to settle, compromise and pay any and all Claims or causes of action which are brought against Maybe Meetings without the prior consent of the User.
Maybe Meetings provision of the Services
Maybe Meetings provides any and all information contained on Maybe on an "as is", "as available" basis and has taken reasonable measures to ensure the currency, availability, correctness and completeness of such information. Maybe Meetings does not give or make any warranty or representation of any kind about the information contained on Maybe Meetings, whether express or implied. Use of Maybe Meetings and the materials available on it is at the sole risk and responsibility of the User. Maybe Meetings takes no responsibility for any loss arising from the transfer or use of data or inaccurate Content posted by Maybe users. The User is responsible for taking all necessary precautions to ensure that any material that may be obtained from Maybe or Maybe Meetings is free of viruses or other harmful components. The User accepts that Maybe or the Services will not be provided uninterrupted or error free, that defects may not be corrected or that Maybe, or the server that makes it available, are free of viruses or bugs, spyware, Trojan horses or any similar malicious software. Maybe Meetings is not responsible for any damage to the Users computer hardware, computer software, mobile operating system or other equipment or technology including, but without limitation damage from any security breach or from virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure or any other malfunction.
Termination of use by us
Upon the Users breach of the Terms, submission of Content or use of the Maybe services in a matter that is in breach of the Terms or not consistent with the purpose of the Maybe services, Maybe Meetings reserves the right at their sole discretion, at any time and without liability or the need to give the User prior notice or to refund any unused Maybe Credits or subscription for Maybe Unlimited, to:
- suspend or revoke the User, the Users Maybe account and Profile (where applicable) and the Users right to access and/or use Maybe or the Services or submit any Content to Maybe; and
- make use of any operational, technological, legal, or other means available to enforce the Terms.
Maybe Meetings will, without any express obligation thereto, make reasonable efforts to notify a User if their access to Maybe and/or their Profile is to be or has been suspended or terminated.
Termination of use by the User
Content that the User has uploaded to Maybe, other than the Users Profile (such as messages or chat messages to other Maybe users), may still appear on Maybe or the Services after termination of a User account.
Uninstalling Maybe from the Users mobile phone does not constitute a termination according to the Terms.
Maybe Meetings reserves the express right to modify, update or amend these Terms at any time (a “Amendment”). Any Amendment will be posted on the Website and with the third party service providerand the effective date of the updates will be incorporated in the Terms. In certain circumstances, Maybe Meetings may send an email to the User notifying of any Change. In the event that the User does not accept any Amendment, the User should stop using Maybe immediately. The Users continued use of Maybe Meetings following any Amendment constitutes an express acceptance of the Amendment and the User will in effect be legally bound by the new updated Terms.
If, for any reason, any of the Terms are declared to be illegal, invalid or otherwise unenforceable by a court of a competent jurisdiction, then to the extent that term is illegal, invalid or unenforceable, it shall be severed and deleted from the Terms and the remainder of the Terms shall survive, remain in full force and effect and continue to be binding and enforceable on both parties.
These Terms constitute the entire agreement and understanding between the parties in relation to the use of Maybe and the Services and supersedes all previous agreements, representations and arrangements between the parties (whether oral or written).
No failure or delay by Maybe Meetings in exercising any right, obligation or privilege under the Terms shall constitute a waiver of such right or acceptance of any variation of the Terms. No exercise in whole or in part by either party of any right, obligation or privilege shall limit any further exercise of that right or the exercise of any other right, power or privilege.
The Terms and any dispute or claim arising out of or in connection with it or its subject matter (including non-contractual disputes or claims) shall be governed by Swedish law and finally settled exclusively by the Swedish civil courts. In the event there is a discrepancy between this English language version and any current or future translated copies of the Terms, the English version shall prevail.
